This volume presents a selection of papers from the Poincaré Project of the Center for the Philosophy of Science, University of Lisbon, bringing together an international group of scholars with new assessments of Henri Poincaré's philosophy of science-both its historical impact on the foundations of science and mathematics, and its relevance to contemporary philosophical inquiry. The work of Poincaré (1854-1912) extends over many fields within mathematics and mathematical physics. But his scientific work was inseparable from his groundbreaking philosophical reflections, and (...) the scientific ferment in which he participated was inseparable from the philosophical controversies in which he played a pre-eminent part. The subsequent history of the mathematical sciences was profoundly influenced by Poincaré's philosophical analyses of the relations between and among mathematics, logic, and physics, and, more generally, the relations between formal structures and the world of experience. The papers in this collection illuminate Poincaré's place within his own historical context as well as the implications of his work for ours. (shrink)

This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

Este artículo examina la compleja relación entre democracia y derechos fundamentales, argumentando que una perspectiva histórica de los derechos, que es indispensable, no necesariamente justifica su existencia en términos historicistas. Señala que la expansión y generalización de los derechos han planteado desafíospara definir un concepto unificado de derechos fundamentales. Además, critica la percepción romántica de que la democracia es suficiente para garantizar estos derechos, especialmente en un contexto de crisis de representación, corrupción y otros desafíos contemporáneos. El artículo también aborda (...) la disyuntiva entre democracia y capitalismo, especialmente en su forma neoliberal, argumentando que esta alianza ha sido problemática y ha contribuido a la erosión de los derechos sociales. Se destaca que, aunque las democracias pueden violar los derechos humanos, estas violaciones no son sistemáticas y hay mecanismos para denunciarlas y corregirlas. It is relevant to interpret the perception that students with disabilities, teachers, and managers have about an inclusive educational program, to identify and describe the facilitators and barriers during the training of those students; analyze the relevance of the inclusive program from the perceptions of the participating actors; and assess the program's supports from the perception of students with disabilities. This is a mixed investigation of sequential design and phenomenological approach carried out through surveys and in-depth interviews with the actors.

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. Además, expone algunas concepciones de la justicia, principalmente de Kant, Kelsen, Ross, Bobbio, Rawls, Habermas, Dworkin, Finnis y Sen, con el propósito de que la exposición sirva a estudiantes de derecho al momento en que deban ocuparse de los fines del derecho y, entre éstos, de la justicia.

We may not know precisely what globalization consists of and what its outcome will be —supposing that such complex processes have an outcome, as such—, it is nonetheless real. However, it is also something that we can idealise. I do not mean idealise in the sense of changing what we call globalization at will. Rather, it is a matter of using our intelligence to raise this process above its own reality itself.

The controversy between Euclidean and non-Euclidean geometry arose new philosophical and scientific insights which were relevant to the later development of natural science. Here we want to consider Poincaré and Helmholtz’s positions as two of the most important and original ones who contributed to the subsequent development of the epistemology of natural sciences. Based in these conceptions, we will show that the role of philosophy is still important for some aspects of science.

The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)

Much of the focus on Poincaré’s philosophy of science has been on the notion of convention, a crucial concept that has become distinctive of his position. However, other notions have received much less attention. That is the case of verifiable hypotheses. This kind of hypotheses seems to be constituted from the generalization of several observable facts. So, in order to understand what these hypotheses are, we need to know what a fact to Poincaré is. He divides facts into brute and (...) scientific facts. The characterization of this duality is not trivial at all, and leads us to the following questions that we will discuss in this paper: which the part of construction that exists in a scientific fact and which the part of translation, that is, what remains from the brute fact in the scientific one?; and when we conceive a generalized hypothesis, are we supposed to do it from scientific or from brute facts? The clarification of these questions could lead to distinguish the part of construction and the part of translation in the first steps of science, which is essential to get a better understanding of Poincaré’s conception of science. In the present article, we attempt to elucidate the conceptual rela- tionship between censorship and emotional development. We employ a framework from emotion regulation studies in order to clarify how censorship works and to ex- plain why it cannot affect emotional development in the same way as the remaining types of emotional regulation. Nevertheless, we argue that, by focusing on Plato’s ac- count of censorship, and specifically of its sociocultural function, one can find that it is not a useless device (...) for emotional development. Censorship affects relevant variables in the dynamics of contraposed emotional processes that compete for dominance. (shrink)

In this paper I will defend the idea of the success of post-truth as one of the main features of hypermodernity. In order to understand such a claim, I will start by defining “post-truth” and showing the key differences that separate it from simple manipulation or lies. I will explain how post-truth characterizes a whole new way of understanding the difference between truth and falsity: a new attitude of indifference to the sharp distinction that moderns and ancients had placed between (...) these two notions. I will contend that this new attitude had been announced by the work of at least three recent philosophers: Harry Frankfurt, Gianni Vattimo and Mario Perniola. They give different names to “post-truth”, though, and attribute it to different causes (from anti-intellectualism to the new media and to sheer carelessness). After that, I will explore how two key aspects of hypermodernity (according to Gilles Lipovetsky), i.e. hyperindividualism and hyperconsumption, cohere with this spread of post-truth. Finally, I will summarily refer to some political and geopolitical events that corroborate the relevance of post-truth in our hypermodern world. (shrink)

Una importante amenaza para la comunicación intercultu-ral es el relativismo: la idea de que cada cultura es tan diferente a las demás que resulta imposible entender nada de una de ellas desde cualquier otra. Se trata, de hecho, de una noción que cobró cierto éxito en diversas áreas del saber durante el siglo XX. Para oponerse a ella, los filósofos a menudo han intentado encontrar qué es lo que sí tienen todas las culturas en común, con el propósito de que (...) sirva de punto de apoyo para la comprensión mutua. En este artículo, empero, intentamos mostrar cómo cabe refutar las ideas del relativismo sin tener a la vez que comprometerse con una u otra idea de lo que presunta-mente puedan tener todas las culturas en común. El pensamiento de Richard Rorty será el que nos sirva de guía para ello. Veremos por qué, según este autor, el relativismo puede considerarse en realidad una idea incomprensible y, por tanto, que puede ser abandonada; y por qué, aunque nos confesemos etnocéntricos (como él se confesaba), ello no nos cierra a la comunicación con otras culturas, sino que, bien al con-trario, nos invita a entenderlas y a ampliar con ello nuestra propia comprensión de nosotros mismos. El uso de argumentos filosóficos tomados tanto de la epistemología elaborada por Donald Davidson, como de la historia del liberalismo político, nos resultarán fecundos en ambos empeños. (shrink)

Este artículo comenta una conferencia de Louis de Broglie de 1952 en la que se replantea sus ideas iniciales sobre la mecánica cuántica. Defenderemos la tesis de que, en ese trabajo, pese a la referencia al indeterminismo, el objetivo del físico francés es presentar una interpretación causal de esta teoría y no poner de manifiesto su indeterminismo. Así, analizaremos la noción de causalidad que presenta con el objetivo de separarla del determinismo. Estructuraremos la noción presentada por de Broglie en tres (...) partes y la conexión entre las mismas. Para separar causalidad de determinismo utilizaremos una definición no restrictiva de esta noción y presentaremos los problemas que tiene la noción de causalidad utilizada por de Broglie. Finalmente, defenderemos una interpretación de las ideas de de Broglie más como una concepción filosófica que científica y ofreceremos alternativas filosóficas a la misma. (shrink)

Muita da literatura sobre a filosofia da ciência de Poincaré tem estado focada na noção de convenção, um conceito crucial que identifica a sua posição. No entanto, há outras noções que têm recebido menos atenção. Este é o caso das hipóteses verificáveis. Este tipo de hipótese parece ser constituído a partir da generalização de vários fatos observáveis. Assim, para compreender o que são estas hipóteses, temos de saber o que é um fato para Poincaré. Ele divide fatos em brutos e (...) científicos. A caracterização desta dualidade não é de tudo trivial, e nos leva às seguintes questões que discutiremos neste artigo: (1) qual a parte de construção que existe num fato científico e qual a parte de tradução? Isto é, o que permanece do fato bruto no fato científico? E (2) quando concebemos uma hipótese generalizada, a generalização é feita a partir dos fatos científicos ou dos fatos brutos? A clarificação destas questões pode levar a distinguir a parte de construção e a parte de tradução desde os primeiros passos da ciência, o que é essencial para conseguir uma melhor compreensão da concepção de ciência de Poincaré. Poincaré’s conventionalism has been interpreted in many writings as a philosophical position emerged by reflection on certain scientific problems, such as the applicability of geometry to physical space or the status of certain scientific principles. In this paper I would like to consider conventionalism as a philosophical position that emerged from Poincaré’s scientific practice. But not so much from dealing with scientific problems, as from the use of two specific methodologies proper to modern mathematics and the modern natural sciences: methodological (...) structuralism and the hypothetical-deductive method—thus, as a philosophical position which emerged from a way (or rather, two ways) ofdoingscience. With this approach, I try to deepen the analysis of connections between Poincaré’s scientific practice and his philosophy. (shrink)

Today, the notion of identity is usually linked with ethical-political discussions like multiculturalism, gender or sexual diversity, recognition of plurality, etc. Nevertheless, the flourishing of this vision that interprets “identity” mainly in its plural form (as “identities”) contrasts sharply with the sense that “identity” has had during most of the history of philosophy (in which identity was understood in connection with “unity” or “selfsameness”, not with “diversity” or “otherness”). In order to explain the passage from one notion of identity to (...) the other (a passage mainly made in the last third of the 20th century), we will focus on the reflections made by Ludwig Wittgenstein towards the middle of that century. Our contention is that these reflections open the way to a more plural understanding of human identity, against the many interpreters of Wittgenstein that defend the opposite: that he offered a strong notion of common human identity in his writings, a notion based on the idea of “human nature”. In order to sustain our thesis, we will have to give an interpretation of some key terms of Wittgenstein’s philosophy (like “forms of life” or “natural history”) from a pluralistic point of view; this is the only way of understanding to what extent he is a predecessor of contemporary discussions about plural identities. This paper discusses the different teaching-learning styles and how they can be applied to university education. It is a common misconception that there are only three learning styles: visual, auditory, and kinesthetic. There are nine different learning styles that can be applied to university teaching-learning. With a literature review, these nine different learning styles and how they can be used in the classroom setting will be explored. In addition, teaching techniques and strategies in a university education will be explored. The (...) importance of these techniques and how they can be improved will also be discussed, considering three different methods: active learning, collaborative learning, and self-directed learning, taking into account the integration of technology in its design. Finally, a dissertation will be made on the new forms of teaching for the training of professionals for industry 4.0 and the new labor demands. (shrink)

We focus on the literature about UBI and the experiments developed all around the world to test it in order to address how UBI implementation could affect entrepreneurship. Building on these findings and various strands of entrepreneurial theory, we develop a theoretical framework to explain how the implementation of UBI would dramatically change the environment of entrepreneurial activity, shaping entrepreneurial action at three levels: (i) the desirability of becoming an entrepreneur; (ii) the perceived feasibility of becoming an entrepreneur; (iii) the (...) propensity to act. Consequently, UBI implementation would arguably facilitate the decision to become an entrepreneur. The contribution of the paper is threefold. It firstly provides a theoretical framework that opens new directions for further research on the relationship between UBI and entrepreneurship. Secondly, it offers new insights for policy makers by shedding light on potential effects of UBI implementation. Finally, it raises further questions that remains unsolved related to the role of non-pecuniary motivations and financial constraints. (shrink)

The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. Technoscience is increasingly present in our daily lives, establishing new social rules and patterns of communication and interaction in a physical space, which implements electronic devices and telematic systems in its design. In the race for scientific progress, the goal is making man a God, like Nietzsche’s Superman, without determining how the new human morphology will be fitted. This paradigm is treated by artists who warn of the possible fate of humanity while the technoscientific, as if he or she was (...) Prometheus, dares to defy the laws of nature. Art exposes the actual course of science, and some artists complain that the false promises of scientific discourse, which is dominated by male vision, fail to be aware of the impossibility that technology is going to improve the moral dimension of human being. Some artists say that the science sermon does not deal with humanity and that the building of our future is merely phallocentric, an excessive anthropocentric vision. (shrink)

¿Cuál debe ser la actitud de un pensamiento genuinamente postmoderno ante el fenómeno religioso? ¿Debe contribuir a desterrarlo de nuestras sociedades o, por el contrario, debe colaborar en su emergente renacimiento? La filosofía de Gianni Vattimo constituye una respuesta a esta disyuntiva desde una perspectiva que pretende distorsionar tal dicotomía. La idea clave para ello es el concepto de secularización que a la vez que reconoce nuestra dependencia, como occidentales, de un cierto discurso religioso, lo debilita con el fin de (...) eliminar de él su violencia. El presente artículo analiza someramente estas ideas y traza algunas de sus conexiones con el pensamiento teológico más reciente, para después reseñar algunas de las consecuencias que han tenido en los debates filosóficos hispanos. If we classify ethical theories into ‘immanentist’ (those that detect what is ethically acceptable in some type of world events, such as the utilitarian growth of general benefits) and ‘transcendentalist’ (those that locate in some space beyond this world the reason why we should behave ethically – for example, due to some kind of otherworldly reward –), then the moral philosophy of the so-called ‘first’ Wittgenstein would occupy a special place between both extremes of such a dichotomy. To a certain (...) extent, it could be said that the ethical proposal of Wittgenstein during his years composing the Tractatus Logico-philosophicus maintains a delicate balance that avoids both its exclusive submission to transcendental instances (fundamentals), and its total assimilation by immanent motivations (benefits) when justifying the fact of acting in a correct way. In this article we will look at such a Wittgensteinian pirouette between both members of the transcendent-immanent dualism, and we will suggest that the peculiar place where he leaves ethics, between the heavenly and the earthly, may not be completely alien to some thesis of the Christian religion. From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 Lienü Zhuan 列女傳 and the (...) philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy.
